Terms and Conditions
Please see your contract and release for full and specific terms and conditions relating to your photography session and images.
PAYMENT – For all bookings, payment IN FULL is required to be received by me PRIOR to the photography session taking place. This can be by bank transfer, ensuring that the funds are received in my account one day prior to the session or I can organise with you to pay cash on the day of the session. If payment in full is not received, I reserve the right to decline to undertake photography work. If a wedding booking is cancelled within two weeks of the date of the session, 80% of the full fee becomes due and payable.
PAYMENT ARRANGEMENTS – Payment arrangements can be entered into by agreement. This will be contained in the contract and is subject to acceptance. Only reasonable payment arrangements will be considered, and payment in full is still required prior to the photography taking place.
PHOTOGRAPHER – If I am unwell or unable to make the photography session for any reason, I will endeavour to find a suitable replacement as soon as possible. This will be communicated with you. I also do my best to take the highest quality photographs with high quality equipment, and have backup equipment available. If for some reason, my equipment should fail, you are entitled to a full refund, or a rescheduled session if this is possible.
NON REFUNDABLE BOOKING FEES – For all bookings, a 30% non refundable booking fee is required to confirm your booking and hold your date. This will need to be paid to me via bank transfer (and funds cleared) or received by me in cash within 14 days of making your booking, or your date will not be held for you. If you cancel your photography session, your booking fee will not be refunded under any circumstance.
COPYRIGHT AND IMAGE RELEASE – Please note that the copyright to all images is and will be owned by Jacqui Williams Photography and will not be sold or provided to any other party under any agreement under any circumstances. As such, images will be used for social networking (including my Facebook page), website, promotion, advertising use, training use and entry into competitions, unless discussed prior to your photography session or wedding. It is your responsibility to ensure that all people in the images, including children, have given permission for their images to be used on social media, such as Facebook, prior to signing the Release.
CONTRACT – For all large sessions, you will be required to sign a contract and release document containing a full list of terms and conditions, prior to any photography occurring. This contract will be specific for you and your needs. Photography will not proceed unless this document is signed and returned to me either electronically, or in hard copy on the day. Once you sign this document, you are taken to have understood and agreed to the terms and conditions contained in it, so it is important to read it. The terms and conditions of this document cannot be altered after the photography session. In the absence of a written contract, the terms and conditions contained here are taken to be binding once the fee for the session has been paid.
BIRTH PHOTOGRAPHY – This will only take place with prior consent of the required hospital staff, such as ward coordinators, nurses or obstetrician. If photography is required for more than one hour, this can be negotiated in advance. If paid car parking is required, this will be added to the fees. A travel fee of $50 will be required for travel to any hospital south of North Adelaide.
CANCELLATIONS – Booking fees will not be refunded on cancellation of your session under any circumstance. If the session is cancelled within a week of the session, the payment for any rebooked session will be required in full to hold the date. The forfeited booking fee will not be credited towards the new session. If a wedding booking is cancelled within two weeks of the date of the session, 80% of the full fee becomes due and payable. On the occasion that I must cancel your session due to my requirement to attend a birth session urgently, I will either refund your payment in full, or reschedule your session if possible.
In general, these terms are taken to have been understood and accepted by you, at the time that you confirm your booking and/or pay for your session. It is recommended that you read and understand each and every term and condition and how it relates to you.
